Start Up

We advise on the issues which a prospective proprietor should bear in mind in deciding whether or not to commence trading. Once the proprietor has decided to start up in business, we advise on the material factors which need to be considered when choosing the most appropriate business vehicle.

Once that has been identified, we advise on the steps which are involved in setting up the chosen business vehicle. Where there is more than one person setting up in business, they will usually need a form of agreement to regulate the relationship of such joint proprietors. For a partnership, this will involve a partnership agreement.

For a Limited Liability Partnership this will involve a member’s agreement and for a limited company, this will require a shareholders agreement. In addition to formation issues, we advise on raising finance for a new business. Various types of business documentation will be required and the extent of these will depend upon the type of business involved. Employment advice will usually be key in this process and we have lawyers who can assist with this aspect.
