Property Dispute Success
Judgment was handed down this week in a complex and long-running dispute in which Tim Watson, Partner and Head of Dispute Resolution at Brewer Harding & Rowe, represented the successful Claimant.
In his written judgment, following a 5-day trial at the High Court in Bristol, Mr Justice Richards addresses several issues, including:
- The correct test for interpreting court orders;
- Whether, in these particular circumstances, a sale of property by a mortgagees was a sale to themselves and therefore void
- The extent to which trustees and/or mortgagees can recover money spent on trust/mortgaged property;
